US Customs Brokerage Latest Updates From Krieger Worldwide

Important Updates Related to US Customs Brokerage

  • Change of address: Importers are reminded that if their company address changes, they must notify their customs broker. A new CBP Form 5106 (Importer Identity Form) must be completed to ensure records are properly updated in CBP systems.
  • ACH refunds: Importers are encouraged to enroll in ACH refunds to expedite the receipt of duty refunds. ACH provides faster, more secure refund processing compared to paper checks. Enroll in ACH refunds by following these instructions.
  • USMCA certificates: USMCA certificates of origin should be provided at time of entry. Please ensure that you have all supporting documentation, such as qualifying statements and certificates of origin, prior to importing under USMCA.

Update on Recent Executive Order Affecting Reciprocal Tariffs

On Friday evening, Aug. 5, President Trump issued a new executive order revising the scope of previously imposed reciprocal tariffs. The tariff changes set forth in this order take effect on Monday, Sept 8, 2025.

The executive order modifies Annex II to Executive Order 14257, which governs articles exempted from reciprocal tariffs. A small number of goods are being added to the exempted list, including certain bullion-related articles, critical minerals and pharmaceutical products under pending Section 232 investigations, while others are being removed from the exemption list, such as specified aluminum hydroxide, resin and silicone products. Goods removed from Annex II will now be subject to reciprocal tariffs beginning Monday.

The order also introduces a new Annex III, identifying products that may be considered for tariff reductions as part of future trade negotiations. These include:

  • Products not produced, or not produced in sufficient quantities, in the United States
  • Certain agricultural products
  • Aircraft and aircraft parts
  • Non-patented articles for pharmaceutical use

These are for consideration in the future, and are not currently in effect.

Update on US-Japan Agreement Tariffs

As with the recent U.S.-EU agreement, imports from Japan are subject to the higher of either the 15% tariff or the Column 1 MFN rate:

  • If the column 1 rate is below 15%, an IEEPA reciprocal duty is assessed to bring the total tariff up to 15%.
  • If the column 1 rate is above 15%, only that higher MFN duty applies, with no additional IEEPA reciprocal duty.

This framework was established in the executive order issued by President Trump last week. CBP has clarified implementation through a trade message, specifying that the tariffs apply retroactively to Japanese-origin goods entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. EDT, Aug. 7, 2025. CBP further advised that, due to this retroactive provision, the trade community should not file post summary corrections (PSCs) or protests until specific instructions are issued. Additional guidance will be communicated through CBP Cargo Systems Messaging Service (CSMS) notices.

Extension of Section 301 Exclusions

Section 301 exclusions have been extended through Nov. 29, 2025. The exclusions were previously scheduled to expire on Aug. 31, 2025. The Federal Register notice can be viewed here.
