New Trade Developments: Malaysia, Cambodia, Thailand and Vietnam

The Trump Administration has announced new trade agreements with Malaysia and Cambodia and new frameworks for agreements on reciprocal trade with Thailand and Vietnam.

Further negotiations are required before the United States can finalize trade agreements with Vietnam and Thailand, but these frameworks signal progress toward deeper economic alignment.

For Vietnam and Thailand, the United States will identify specific Annex III products to receive a zero percent rate under Executive Order 14346 (Sept. 5, 2025).

For Malaysia and Cambodia, the U.S. has committed to maintaining the 19% reciprocal rate established in Executive Order 14257 (April 2, 2025) while designating Annex III products eligible for exemption.

Each country’s fact sheet references Annex III, which lists products that may qualify for zero-percent reciprocal tariffs.

CBP Modernization Is Accelerating: Importers Need Their Own ACE Accounts

As CBP continues to modernize its systems, it’s becoming increasingly important for importers to have their own Automated Commercial Environment (ACE) Portal account.

Owning your own ACE account provides direct visibility into your company’s import data, duties and compliance posture, empowering your business to act faster, stay informed and strengthen your internal trade controls.

Simplified Account Setup Is Coming Soon

CBP is rolling out a new, automated way for importers to create ACE accounts using the contact information already on file through CBP Form 5106 (Create/Update Importer Identity Form).

This means importers will soon be able to register directly online, but only if their Form 5106 contact information, especially the email address, is accurate and up to date.

Review your 5106 details with your brokerage team to ensure the addresses on file are correct. You may choose to update your 5106 to ensure proper names and email addresses are correct and belong to someone currently at your company who can manage the account setup and future communications with CBP. The person listed should be knowledgeable about import operations.

Duty Payments Are Moving Fully Electronic

CBP is expanding its requirements for importers who participate in Periodic Monthly Statement (PMS) payment programs to pay supplemental duties electronically via ACH.

Having your own ACE account ensures you can monitor and manage these ACH payments directly, view real-time billing status, and reconcile payments without waiting for broker reports.

If you use PMS or plan to, make sure your business has ACH debit or credit capability in place. Get ACE access so your accounting or compliance team can verify payments directly in the system.

Getting Started

  1. Confirm your company’s 5106 contact information is correct and includes an active email monitored by your team.
  2. Designate internal users who should have view or management access (compliance, finance, logistics).
  3. Familiarize your team with ACE’s dashboards, reports and payment monitoring features.
  4. Apply for your own ACE Portal account through CBP’s online registration (launching soon).
